Clubhouse

The Owen Glen Property Owners’ Association, Inc. (OGPOA) recreational areas (Pool, Tennis Courts, Clubhouse, and Common Areas (also known as the “Amenities”)) are entirely funded by annual dues paying members.  The OGPOA Board of Directors (the “Board”) administers the Rules and Regulations of these areas. Use of these recreational areas by Members and their guests (“User” or “Users” is a privilege that is extended to only Owen Glen Property Owners whose annual and special dues are paid in full.  All guests must be accompanied by a Member when using the Amenities.

No use of the Amenities may be used by any person, including but not limited to minors and guests, without the user, for himself or herself, his or her minor children and each guest having fully executed a “Release of Liability, Assumption of Risk, Hold Harmless and Indemnification Agreement” (the “Release”) as provided by the Board. 

Any use of the Amenities without a fully executed Release being on file with the Board is and will be considered a trespass.


Rules and Regulations Pertaining to the Use of the Clubhouse:

Section 2. Community Clubhouse:

 

The Clubhouse will be utilized for OGPOA group sanctioned activities only.

 

Only (1) property owner may reserve the Clubhouse. The property owner must be present at all times at the function for which the Clubhouse is used and must be the primary host of the event. Property Owners may not reserve the area on behalf of a third party. 

 

Members may reserve the clubhouse in advance by completing a request form.  A signed Release must be received by the Board for all Users, any other User being a trespasser.  The property damage form on the website must be signed by the Member and submitted to the Clubhouse committee. A deposit of $250 is required in advance to cover cleaning and damages. This is refunded if not needed.

No smoking is permitted within the clubhouse at any time. No pets are allowed in the clubhouse.

Music, and/or any other noise, must be kept at a level that it cannot be heard in the surrounding homes in the area.  The property owner will be responsible for seeing that there are no loud noises from the guests either coming to or leaving the function at the Clubhouse. 

The property owner will be responsible for the repair or replacement of any damage done to the Clubhouse, or its furniture, equipment, or window coverings.  Nothing may be taped to the windows, doors or walls. 

The property owner who reserve the Clubhouse will be responsible for cleaning the Clubhouse, the rest rooms and any other area used, including all equipment and furniture, immediately after the function ends.  Cleaning includes vacuuming or damp mopping the floor as needed, and wiping down the counter tops, tables and chairs.  The property owner will also be responsible for placing all trash in the appropriate trash containers.

The property owner will assume full responsibility for any and all accidents or claims that may arise as a result of any accident or for any other reason in connection with the function or lease of the Clubhouse by the property owner and said owner shall agree to the hold harmless and indemnity provisions contained in the liability waiver submitted with the request form.

Heat and/or air conditioning must be returned to the original setting (Heat 60 degrees/Air Conditioning 80 degrees) and lights are to be turned off by property owner when the function is over.

All functions must end by 10:00 p.m. on weeknights and by 12:00 am on Friday or Saturday nights.

The Board in its sole discretion will determine violation of these rules.  The Board of Directors addresses violations to clubhouse rules and policies on a case-by-case basis.  Members of the Board will decide if a violation has occurred hearing from the person(s) claiming the violation, the property owner who reserved the Clubhouse, and any other relevant people.  Property Owners concerned about a possible violation in progress are instructed to contact the police.  For a 1st offense, consequences to the property owner may include forfeiture of the $250 deposit and a 6 month waiting period before being able to use again.  For a 2nd offense, forfeiture of the deposit and a 1 year waiting period.
